By using our site or requesting a free estimate, you agree to these Terms. If you do not agree, please do not use our website or services.

The phone numbers collected during the SMS consent process will not be shared with third parties for marketing purposes.

If you have consented to receive text messages from DynamicZ Construction, you may receive conversational SMS messages related to the following: 

  •  Customer care: Confirming appointments and sending a delay notice.

  • Delivery Notifications:  Notifying clients we are on the way.

  • Marketing: Returning or reaching out to leads we received from our marketing suppliers makes communication easier with new and old clients to avoid confusion with spam numbers - Setting up meetings

Message frequency may vary depending on the type of communication and your engagement.

  • Estimate Requests: Free estimates are provided for informational purposes only and are not final until a site visit is completed by a project manager. We reserve the right to refuse service at our discretion.

  • Project Agreements: Final project details, including scope, timeline, and costs, will be outlined in a separate written contract after the estimate process. These Terms do not constitute a contract for construction services.

  • Client Responsibilities: You agree to provide accurate information for estimates and, if a project is agreed upon, to provide access to the property and a safe work environment for our team.

  • Change Orders: Any changes to the project scope after a contract is signed may result in additional costs and timeline adjustments, as outlined in the project contract.

11. Intellectual Property

  • All content on our website, including project photos, designs, and text, is the property of DynamicZ Construction or its licensors. You may not use, reproduce, or distribute our content without our written permission.

  • Any project designs or plans created by DynamicZ Construction remain our intellectual property unless otherwise agreed in writing.

12. Limitation of Liability

  • DynamicZ Construction is not liable for delays, damages, or errors beyond our control, including but not limited to:

    • Weather events, natural disasters, or pandemics.

    • Supply chain disruptions or material shortages.

    • Client delays (e.g., failure to provide access to the property).

    • Third-party issues (e.g., subcontractor delays).

  • We do not guarantee project outcomes, timelines, or specific results, as construction projects are subject to unforeseen circumstances.

  • To the fullest extent permitted by law, our liability for any claim arising from our services shall not exceed the amount paid by you for the specific service in question.

13. Warranty Disclaimer

  • Our services are provided “as-is.” We disclaim all implied warranties, including warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

  • Any warranties on our workmanship will be outlined in your project contract (e.g., a 1-year workmanship warranty, as applicable).

  • We reserve the right to terminate your access to our website or services if you violate these Terms or engage in behavior that is harmful to our business (e.g., providing false information, harassing our staff).

  • You may terminate your relationship with us at any time before a project contract is signed by notifying us in writing.

  • Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation.

  • If negotiation fails, disputes will be resolved through binding arbitration in California, in accordance with the rules of the American Arbitration Association, except where prohibited by law.

  • You agree to waive your right to a jury trial and to participate in a class action lawsuit against DynamicZ Construction.

  • These Terms are governed by the laws of the State of California. Any legal actions not subject to arbitration will be resolved in California courts.
